COMMISSION MEETING MINUTES

July 12, 2011

 

            The Board of Davis County Commissioners met in room 236 of the Davis County

Courthouse, Farmington, Utah on July 12 at 10:00 a.m.  Members present were Chairman Louenda H. Downs, Commissioner P. Bret Millburn, Commissioner John Petroff, Jr., Clerk/Auditor Steve S. Rawlings, Chief Deputy Civil Attorney William K. McGuire, and Deputy Clerk/Auditor Linda May.

 

            Neka Roundy, Davis County Community and Economic Development Office, led the Pledge of Allegiance.  All were invited to stand and join in.

Farmers Market Botanical Center

            Chairman Downs announced the Utah Botanical Center Farmers Market will be begin on Thursday, July 14 and be open each Thursday until October 13, 2011, from 5 – 8 pm.

Miss Davis County Scholarship Pageant on July 16

            Neka Roundy, Davis County Community and Economic Development Office announced the following:

            Friday night, July 15 at 10:00 pm will be the 18th Annual Antelope Island Moonlight Bike Ride.  It is great fun with many people decorating their bikes and wearing costumes.  Prizes will be given for the best costumed rider or best decorated bicycle involving the theme.  The theme this year is “Deathly Shallows”.  As of this morning, there were 986 people pre-registered.  Davis County is partnering with Syracuse City for a tailgate party at 5:00 pm. at the Syracuse 6 Movie Theater in conjunction with the final theater showing of Harry Potter “Deathly Hallows”.  All are invited.

            The Miss Davis County Scholarship Pageant will be held at 7:00 pm, July 16, at Davis High School. If you want additional information you can contact Natalie Murray at 801-510-0577.  The current Miss Davis County, Ciera Pekarcik, was recently crowned the second runner-up in the Miss Utah Pageant and we all are very proud of her.  At 3:00 pm at Davis High School will be the Miss Davis County Outstanding Teen Pageant.

Presentation of 2010 CAFR

            Steve Rawlings, Davis County Clerk/Auditor, introduced Jeff Ambrose, Crane, Christensen & Ambrose.  Jeff Ambrose and his team have audited the financial statements of Davis County for 2010.  Steve thanked Jeff for his efforts.  Steve also expressed appreciation to Clerk/Auditor’s staff members Jonathan Lee, Doug Stone, LynnAnn Winterton, Curtis Koch, Terry Tremea, and Dax Teuscher, for their assistance with the audit.  In compliance with full disclosure, anyone who requests a copy of the Comprehensive Annual Financial Report (CAFR) can receive a copy.  The cost for the annual audit is about what some counties half our size pay.

            Jeff Ambrose thanked the county for the opportunity to provide the services and stated they are locked in for a five-year period to perform the audit at the current cost.  Jeff also thanked those who Steve already mentioned for helping with the audit and also thanked Mark Altom, Davis County Treasurer, for assistance.  They all help with the efficiency of accomplishing the audit.  We performed the audit according to the planned scope and timing previously communicated.

            Jeff stated he wanted to call attention to the following pages with the CAFR:

            Page 12:  A copy of the Certificate of Achievement for Excellence in Financial Reporting presented to Davis County from the Government Finance Officers Association of the United States and Canada.  It is the 17th consecutive year for Davis County to receive the award.

            Pages 18 -19:  These two pages give the Independent Auditors’ Report regarding the financial statements of Davis County.  Davis County was given an unqualified and clean opinion.  It is the highest rating given.

            Pages 32 -113:  Give the statistics of Davis County assets, expenditures, revenue funds etc.

            Page 20 – 27:  Is a discussion and analysis of Davis County’s financial performance and activities for the year ended December 31, 2010.  When read in conjunction with the letter of transmittal and the notes to the financial statements, this section’s financial highlights, overview and analysis should assist the reader to gain a more complete knowledge of the County’s financial performance.  Comparative analyses to the previous year’s results are provided. 

            Pages 32 – 33 Outline the Government-wide Financial Statements.  In the General Fund the cash and fund balance is healthy.  General Fund is $19.8 million.  The General Fund increased $3.5 million.

            Page 74 – 79 provide supplemental information of schedules of revenues, expenditures, and changes in fund balance. No funds were overspent.  All departments worked within budget perimeters.

            Jeff said, “If anyone has a question they can ask the Clerk/Auditor staff or give him a call.”

            Chairman Downs asked all those staff members named to stand and be recognized.  They received a round of applause.

            Commissioner Millburn thanked the staff of the Davis County Clerk/Auditor’s Office.  He also thanked all the departments for their efforts with budgets.  Money was turned back to the General Fund from departments.

            Chairman Downs stated that she is not surprised we are in such good shape.  Long range planning has been utilized. The results of planning and positioning have put Davis County in a good place in the bond market.  Flood control and capital improvements have been made possible because of this position.

            Commissioner Petroff stated we have great departments in Davis County.  We have many young people dedicated to doing the right thing.  Citizens are the benefactors.  We plan well, track well, and it can be seen with the outside audit.

 

            Tanya Perkins, Davis County Children’s Justice Center Director, introduced Susan Burton who hired on with the Children’s Justice Center as the Development & Training Coordinator in April.  She will be assisting with grants and other administrative issues.  Tanya presented the following:

Agreement #2011-220 Travis Peterson to Provide Training for Forensic Interviews

            Agreement #2011-220 with Travis Peterson.  Travis will provide training and feedback to detectives and CPS investigators who conduct forensic interviews at the CJC.  The design is to develop the highest possible skill set for forensic interviewers and also to increase the expertise of each interviewer such that they are meaningfully able to help others improve their interviewing skills.  It is a payable of $5,512.00 for the remainder of 2011.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Amendment #2011-104A UT Office of Crime Victim Reparations for a Funding Reduction

            Amendment #2011-104A with the State of Utah, Office of Crime Victim Reparations, for a reduction in the amount of the grant award by $3,101.58.  The VOCA grant is used toward the salary of the victim services coordinator.  The contract period is July 1, 2011 – June 30, 2012.  Steve Rawlings, Davis County Clerk/Auditor stated the 15% reduction will be reprioritized by the Davis County Attorney’s Office and the budget change as listed on the agenda will not be necessary.  Commissioner Petroff made a motion to approve the grant.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

 

            Megan Hatch, Davis County Legacy Events Center Fair Coordinator, presented the following:

Agreement #2011-221 K12 for Sponsor at 2011 Davis County Fair

            Agreement #2011-221 with K12.  It is a sponsor agreement for K12 to sponsor the Davis County 2011 Fair Science Discovery Tent.  It is a receivable of $1,500.00.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2011-222 Horizon Credit Union for Sponsor at 2011 Davis County Fair

            Agreement #2011-222 with Horizon Credit Union.  It is a sponsor agreement for Horizon Credit Union to be the title sponsor of the Davis County 2011 Fair Creative Corner and of the high school spirit day (new event at the fair).  It is a receivable of $4,750.00.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2011-223 Valpak of Northern Utah for Ads for 2011 Davis County Fair

            Agreement #2011-223 withValpak of Northern Utah.  ValPak ads will go out in July and August for the marketing of the Davis County 2011 Fair and will also occur on their website.    There are approximately 90,000 homes that receive their ads.  It is a payable of $3,700.00.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

 

            Megan said they are excited about the opening of the new dog park at the Legacy Events Center.  It is place where dogs can be off lease and socialize with other dogs.  It is divided into two are areas:  (1) dogs 20 lbs and under; and (2) dogs over 20 pounds.  It is open dawn to dusk.  There will be scheduled closures such as when other dog events are scheduled at the center.

Agreements #2011-224

#2011-225 Simple Tresures  Rental/ Legacy Facilities

            Mike Moake presented two agreements for Simple Treasures for rental of Legacy Events Center facilities to hold boutiques as follows:

            Agreement #2011-224                         dates of 9/20/11 – 9/24/11       $3,255.00/receivable

            Agreement #2011-225                         dates of 11/08/11 – 11/12/11      $3,255.00/receivable

Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2011-226 The Main Events Concessions to Operate Concessions at Legacy Events Center

            Dave Hansen, Davis County Legacy Events Center Director, presented agreement #2011-226 with The Main Events Concessions.  The Main Events Concessions will be taking over the concessions stands at the Legacy Events Center.  They will be paying the County 15% of their gross sales.  The contract will run thru December 19, 2011 and after that the contract can be renewed yearly.  Owner, Bicknell Robbins, has offered to accept applications and interview those part-time employees currently working with concessions.

Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

            Bicknell stated that he has worked in Corrections, has a restaurant in Syracuse, and has been a food vendor at the Davis County fair.  He wants to change up the menu and offer more traditional items like cotton candy and new items such as Philly sandwiches. 

            Commissioner Petroff stated that the commission wishes him success as it reflects on us.

 

            Kevin Fielding, Davis County Sheriff’s Office, presented the following:

Agreement #2011-227 Awesome Woodworking for Cabinets

            Agreement #2011-227 with Awesome Woodworking, to build 16 new cabinets for Davis County Sheriff’s Office auditorium (training room).  The cabinets will be installed by a different vendor.  It is a payable of $8,850.00.  This is a replacement item as discussed in the budget and will provide locked cabinets.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2011-228 CCI Mechanical Service for New Water Heater at Jail

            Agreement #2011-228 with CCI Mechanical Service for installation of a new water heater in the Davis County Jail.  The water heater is for in the kitchen and bumps up the temperature of the water for uses with the dishwasher.  It is a payable of $10,887.00.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2011-229 UT Dept of Corrections for Reimbursement of Housing of Inmates

            Agreement #2011-229 with Utah Department of Corrections (UDC) to establish the criteria and rate reimbursement for the housing of inmates at the Davis County Jail.  The average number of prisoners from the state is 60 – 75 and the average number of federal is 150 – 160. Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Amendment #2010-48B Compass Group USA, Inc. for Sale of Additional Items through Commissary

            Amendment #2010-48B with Compass Group USA, Inc.  The additional items identified will be sold to inmates through the commissary.  It is used as management tool as an incentive for inmates to accomplish certain tasks and then they can make purchases on Friday from the commissary.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

 

            Bill McGuire, Davis County Attorney Office, presented the following:

Agreement #2011-230 Layton City to Obtain Byrne Grant Funding

            Agreement #2011-230 with Layton City.  This inter-local agreement is for obtaining a 2011 Byrne grant funding.  The portion Davis County would utilize is $2,005.00 for the purchase of two LCD flat screen monitors for county attorneys’ in-court presentations..  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2011-231 UT Dept of Human Services for Funding for Davis County Drug Court

            Agreement #2011-231 with the Utah Department of Human Services.  It is a receivable of $296,772.00 to fund the Davis County Drug Court.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

            Commissioner Millburn stated this is a very good program.  You can see the impact in individual lives and it is worth every penny.  It is better to have individuals doing something with their lives rather than just sitting in cells.

 

            Commissioner Petroff made a motion to convene as the Board of Equalization.  Commissioner Millburn seconded the motion.  All voted aye. 

Approval of Property Tax Register

            Ross Bartholomew, Davis County Tax Administration Director, presented the property tax register.  Reflected on the register are 283 items.  They included tax abatements, one Treasurer’s Adjustment, and corrections received from Assessor for 2010 value.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.

 

            Commissioner Millburn made a motion to reconvene the regular commission meeting.  Commissioner Petroff seconded the motion.  All voted aye. 

Approval Commission Minutes

            Commissioner Millburn made a motion to approve the commission meeting minutes of June 21, 2011.  Commissioner Petroff seconded the motion.  All voted aye.

Approval Personnel Register

            Commissioner Millburn made a motion to approve the personnel register.  Commissioner Petroff seconded the motion.  All voted aye.

Check Registers Approved

            Check registers as prepared by the Davis County Clerk/Auditor were approved with a motion from Commissioner Millburn.  Commissioner Petroff seconded the motion.  All voted aye.  Documents are on file in the office of the Davis County Clerk/Auditor.

 

            Steve Rawlings, Davis County Clerk/Auditor, reminded everyone that in about 10 days the valuation notices will be going out.  We want taxpayers to have their value information before the tax notices go out in November.  Inside the valuation notice, will be included the appeal form to be used if someone wants to appeal their home’s value.

Commission Comments:

            Commissioner Downs stated that the county has made great strides in establishing accurate values.  Ross Bartholomew and many other have assisted with this process.

            Commissioner Millburn reminded all that Davis County will not do a tax increase.  However, there are other entities who are anticipating doing tax increases.
