COMMISSION MEETING MINUTES

June 28, 2011

 

            The Board of Davis County Commissioners met in room 236 of the Davis County

Courthouse, Farmington, Utah on June 28 at 10:00 a.m.  Members present were Chairman Louenda H. Downs, Commissioner P. Bret Millburn, Commissioner John Petroff, Jr., Clerk/Auditor Steve S. Rawlings, Chief Deputy Civil Attorney William K. McGuire, and Deputy Clerk/Auditor Linda May.

 

            Pat Beckstead, Davis County Election Coordinator, led the Pledge of Allegiance.  All were invited to stand and join in.

 

            Chairman Downs announced the following:

            On Saturday evening June 25, the Miss Utah 2011 Pageant was held.  Ciera Pekarcik, Miss Davis County was crowed second runner-up.  Congratulations to her for her accomplishments.

            July 1 early registration for the 18th Annual Antelope by Moonlight Bike Ride will end.  The ride will be held on July 15th at 10:00 pm.  The theme is “The Deathly Shallows.”

Approval of HA01 as

 By-mail Voting Precinct

            Pat Beckstead, Davis County Election Coordinator, requested approval to administer voting precinct HA01 as a by-mail (absentee) voting precinct for the municipal election.  HA01 has fewer than 100 voters, and the criterion for a by-mail precinct is less than 500 voters in the precinct.  Through the process of using GIS for the 2011 redistricting, it was discovered that there are a few residences on Hill Air Force Base that are actually in Sunset City limits.  Currently there are only three registered voters in the precinct within the city limits and the remainders are in the unincorporated area.  Commissioner Millburn made a motion to approve the by mail voting precinct for this election.  Commissioner Petroff seconded the motion.  All voted aye.

            Pat Beckstead presented the following agreements for Davis County to administer the 2011 municipal elections for the cities:

The filing deadline for candidates for the Municipal Election is July 15.  Pat stated the county has evaluated the process and costs.  The costs have been lowered.  The vote centers will help with the lowering of costs.  Steve Rawlings, Davis County Clerk/Auditor, reminded the commissioners this revenue is not in as part of the budget and after the elections a budget change will come to the commissioners for the revenue and expenses.

Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Amendment #2009-58B Farmington City for Animal Control Services

            Clint Thacker, Davis County Animal Care and Control Director, presented amendment #2009-58B with Farmington City.  Davis County will provide animal control services for the city for a receivable of $36,423.71.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

 

 

Agreement #2011-172 CompView for System at DPGC

           

            Janette Price, Davis County Information Systems, presented agreement #2011-172 with CompView.  The company will provide an audio/video system integration sales and/or service as defined at Davis Park Golf Course.  It is a payable of $13,162.00.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Providers are placed on A, B, and C lists according to charges for their services.  Seniors have the option to choose a provider.  The Contractor assures that it is completely in compliance with all standards according to State of Utah, Federal and County rules and regulation.  Examples of services are:  homemaker, personal care/CAN, respite care, chore, adult day health, non medical transportation, medication dispensing, and bill budget assistance.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Documents on file in the office of the Davis County Clerk/Auditor.  

Agreement #2011-211 Morgan Pavement to Crack Seal Legacy Events Center Parking Lot

            Commissioner Petroff presented agreement #2011-211 with Morgan Pavement.  It is to seal the cracks in the parking lot and restripe the parking lines at the Legacy Events Center.  This regular maintenance should extend the life of the parking lot.  It is a payable of $4,975.00.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

 

            Megan Hatch, Davis County Legacy Events Center Fair Coordinator, presented the following:

Agreement #2011-212 Dodge Rodeo for Sponsorship at PRCA Rodeo

            Agreement #2011-212 with Dodge Rodeo.  This sponsorship names Dodge the exclusive vehicle for the 2011 Davis County Fair PRCA Rodeo.  The contract outlines the exclusive use of Dodge vehicles in arena, number of signs permitted, vehicles to be put on display, and Dodge to be recognized throughout each night of the rodeo.  It is a receivable of $3,500.00.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2011-213 Layton Hills Chrysler Dodge Jeep Ram for Sponsor with Dodge Rodeo

            Agreement #2011-213 with Layton Hills Chrysler Dodge Jeep Ram.  It is a sponsor agreement with Layton Hills Chrysler Dodge Jeep Ram, as the dealership representative for the Dodge Rodeo agreement.  This sponsor has also elected to pay separately for additional sponsorship benefits from the Davis County Fair.  These benefits include being the exclusive care and truck dealer for the Davis County Fair,

co-sponsorship of the Demolition Derby, logo placement on the Davis County Fair T-shirt, and more.  It is a receivable of $1,750.00.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

 

            Kirk Schmalz, Davis County Public Works Director, presented the following:

Notice of Award for ACME Construction Inc.

            A Notice of Award for ACME Construction Inc. for the Stone Creek Box Culvert on Pages Lane in the amount of  $1,367,588.25.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Change Order #2010-308C Reynolds Brothers, Inc.  to Reduce Cost

            A change order #2010-308C with Reynolds Brothers, Inc. is to reduce the cost on the contract by $1,528.91 for the 200 South Storm Drain/Sediment Basin Improvements.  The cost reduction relates to pipes for drainage and Davis County Public Works will do the seeding.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Certificate of Substantial Completion for Reynolds Brothers, Inc.

            A Certificate of Substantial Completion for Reynolds Brothers, Inc. for the 200 South Storm Drain/Sediment Basin Improvements (#2010-308) is presented for approval.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Change Order #2010-247A Whitaker Construction for Barton Creek Flood Control Project

            A change order for Whitaker Construction #2010-247A for the Barton Creek Flood Control Project.  It is for additional costs for Weber Basin Water loops.  It is a payable of $94,950.00.  This work actually benefits three projects.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

J-U-B Engineers, Inc. for Clinton Drain Improvements Phase II

            Agreement #2011-214 with J-U-B Engineers, Inc. for the company to provide technical assistance and engineering services to design, prepare bid documents, and provide construction services for Clinton Drain Improvements, Phase II.  The project is from 3000 West to 4000 West.  It is a payable of $120,000.00.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Change Order #2011-127A Bowen Construction for North Salt Lake Project

            Change Order #2011-127A with Bowen Construction for the North Salt Lake Project.  The additional scope of work is to install a 10” water valve.  It is a payable of $2,600.00.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2011-215 Bowen Collins & Associates for Sediment Basin on Mill Creek Channel

            Agreement #2011-215 with Bowen Collins & Associates for technical assistance and engineering services to design, procure, and construction management for the work to install a sediment basin on the Mill Creek channel in the vicinity of 1100 West in West Bountiful and Notice to Proceed.  The company has expertise about the Mill Creek channel.  It is a payable of $29,200.00.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2011-217 B&G Contractors LLC for Parrish Creek Silt Basin

            Agreement #2011-217 with B&G Contractors LLC for the Parrish Creek Silt Basin-Floor Slab and Notice to Proceed.  It is a payable of $49,900.00.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2011-218 UT Division of Child & Family Services for UA Testing for Court Ordered Clients

            Kevin Fielding, Davis County Sheriff’s Office, presented agreement #2011-218 with Utah Division of Child & Family Services (DCFS) for Davis County to provide UA testing for clients of the DHS/DCFS Northern Region.  It is a receivable in an amount dependent upon services provided.  On June 27 services were provided for 34 people.  It is estimated there could be 300 per month.  The cost is $15.00 - $20.00 depending on the test order and $3 - $5 would be the revenue to the county.  These services are ordered by the courts.  Davis County Sheriff’s Office can do it with the current staff.  Tests are taken during the day and results are run at night.   Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

            Steve Rawlings, Davis County Clerk/Auditor, stated this is the direct cost but does not address overhead.

Approval of Davis County Certified and Proposed Tax Rates for 2011

            Jonathan Lee, Chief Deputy Finance, Davis County Clerk/Auditor’s Office, presented the Davis County Certified and Proposed Tax Rates for 2011:

The tax rates are out on time and the mayors are happy and have expressed appreciation.  Steve Rawlings, Davis County Clerk/Auditor, stated that there has not been much new growth in the county.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  The signed rates will be forwarded to the State Tax Commission according to Utah State Code. 

Resolution #2011-219 to Adopt Tax Rate for South Davis Recreation District for 2011

            Steve Rawlings, Davis County Clerk/Auditor presented resolution #2011-219 to adopt a tax rate for the purpose of levying taxes within the South Davis Recreation District for the year 2011.  The recommendation has been passed and adopted by the Board of South Davis Recreation District and forwarded to the commission for their action. The proposed tax rate is 0.000270 -Interest and Sinking Fund/Bond and 0.000137 - County Service Area. The tax rate for the district will generate total revenue of $2,088,942.00.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

 

            Marshall Scott, Davis County Facilities Management Director, presented the following:

Change Order #2011-95B Mechanical Service Systems for HVAC ATC Project

            Change order #2011-95B with Mechanical Service Systems for the HVAC ATC project.  This change order is for additional materials and labor as required for the Memorial Courthouse regarding pumps in the boiler room and shut off values.  Commissioner Millburn said that the efficiencies will help employees in the offices.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Change Order #2011-136A Cement Works Concrete Construction for Work at Bountiful Branch Library

            Change order #2011-136A with Cement Works Concrete Construction for materials and labor for additional repair work with the concrete at the Bountiful Branch Library.  The improvements should help to keep water away from the building.  It is a payable of $3,000.00.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

 

            Commissioner Millburn made a motion to convene as the Board of Equalization.  Commissioner Petroff seconded the motion.  All voted aye.

Approval of Property Tax Register

            Ross Bartholomew, Davis County Tax Administration Director, presented the property tax register.  The register reflects 16 items for approval.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.

 

            Commissioner Millburn made a motion to reconvene the regular commission meeting.  Commissioner Petroff seconded the motion.  All voted aye.

Approval of Commission Minutes

            Commissioner Petroff made a motion to approve the commission meeting minutes of June 7 and 14, 2011.  Commissioner Millburn seconded the motion.  All voted aye. 

Approval of Check Registers

            Check registers as prepared by the Davis County Clerk/Auditor’s Office were approved with a motion from Commissioner Millburn.  Commissioner Petroff seconded the motion.  All voted aye.  Documents are on file in the office of the Davis County Clerk/Auditor.

 

Commission Comments:

            Commissioner Petroff stated he is looking forward to the great celebration of our country.  Everyone should get out and enjoy.  We all should remember the great sacrifice of others for our freedom.

 

            Commissioner Millburn stated he echoes Commissioner Petroff’s comments.  The new state legislation this year allows for fireworks as legal from June 26 – July 26.  Be safe, exercise caution.  With the wet spring there are many grasses that are high and drying out.

 

            Commissioner Downs stated the commissioners attended a good conference last week with the Utah Association of Counties.  Appreciation is expressed to the DACVB for their presentation of the Utah State Parks.  Thanks to the attorneys who presented on gang related issues.

 

No public comments.

Closed Session

            Commissioner Millburn made a motion to go into closed session per UAC 54-4-205(1)(d).  Commissioner Petroff seconded the motion.  All voted aye.
