COMMISSION MEETING MINUTES

November 29, 2011

 

            The Board of Davis County Commissioners met in room 236 of the Davis County

Courthouse, Farmington, Utah on November 29 at 10:00 a.m.  Members present were Chairman Louenda H. Downs, Commissioner Bret Millburn, Commissioner John Petroff, Jr., Clerk/Auditor Steve S. Rawlings, Chief Deputy Civil Attorney Bill McGuire, and Deputy Clerk/Auditor Linda May.

 

            Kevin Fielding, Davis County Sheriff’s Office, led the Pledge of Allegiance.  All were invited to stand and join in.

 

            Commissioner Bret Millburn introduced Allen Briggs, Fire Management Officer/Forestry, Fire & State Lands, and Dave Vickers, Fire Warden/ Weber Fire District.  It has worked well for Davis County to have the joint cooperative agreement with Weber County District through the Utah Division of Forestry, Fire and State Lands for a shared fire warden.

            Allen Briggs presented the following:

Memorandum of Understanding #2011-371 with Utah Division of Forestry for Cost Share Rudd Canyon fire

            Memorandum of Understanding #2011-371 with the Utah Division of Forestry, Fire and State Lands.  It is the cost share for the Rudd Canyon fire on July 27, 2011.  The fire was on 99% forest service ground with approximately 1% on unincorporated land of Davis County.  The final figure has yet to be calculated.  The fire was human caused and therefore the cost is recoverable.  The legal channels for cost recovery are being pursued.  Multiple entities responded to the fire.  Commissioner Millburn made a motion to approve the cost share.  Commissioner Petroff seconded the motion.  All voted aye.  A final determination of cost will be brought back to the commission.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2011-364 UT Division of Forestry for Use of Federal Excess Personal Property

            Agreement #2011-364 with the Utah Division of Forestry, Fire & State Land.  It is for both parties to mutually agree to abide by certain requirements regarding the provision of Federal Excess Personal Property (FEPP) to the County by the Division. The primary use of FEPP loaned to the County is for use in the fire management program of the State and County. An inventory will be taken annually of the equipment (picture and location).  Commissioner Millburn stated that the County will be the conduit for equipment to be used by fire agencies as Davis County does not have its own fire entity.   There will be approximately 6 pieces assigned in Davis County such as a water tenders and brush trucks.  Dave Vickers stated training is ongoing with several different cities.  Fires caught on initial attack are contained quicker.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2011-365 UT Division of Forestry Wildland Fire Suppression Budget

            Agreement #2011-365 with the Utah Division of Forestry, Fire & State Lands for the 2012 Wildland Fire Suppression Budget.  The budget is prepared based on a five-year average and taxable land unincorporated.  The budget in the amount of $42,011.00 covers money for training, salary for warden, and equipment/supplies.  The equipment for purchase this year is a laptop and GPS. Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Allen stated this summer’s needs were low and it will be a good factor for the future.  Commissioner Millburn stated all local agencies are working well together. Amendment #2010-048C Compass Group USA, Inc.

            Kevin Fielding, Davis County Sheriff’s Office, presented amendment #2010-048C with Compass Group USA, Inc.  It is the renewable contract with Canteen (entity of parent company) to provide the food service for the Davis County jail inmates for costs based on the Consumer Price Index.  The estimated cost is a payable of $975,000.00 for 2012.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Amendment #2010-268A CenturyLink for  Intrastate Metro Ethernet Service

            Mark Langston, Davis County Information Systems Director, presented amendment #2010-268A with CenturyLink.  It amends the Intrastate Metro Ethernet Service to add 100 mbps to the Animal Control site back to the Courthouse. This line also services the I/M Center, Davis Park Golf Course, Central Branch Library, and Valley View Golf Course.   Installation is $1,200.00 with a monthly cost of $828.75 for a 5-year period.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2011-366 Jordan Valley Construction, Inc. for Barton Stone Creek Flood Project

            Kirk Schmalz, Davis County Clerk/Auditor, presented agreement #2011-366 with Jordan Valley Construction, Inc. and Notice to Proceed.  It is for the Barton-Stone Creek Flood Project.  It is a payable of $1,834,270.00.  Commissioner Petroff made a motion to approve.  Commissioner Millburn seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreements #2011-367 & #2011-368 for North American Grappling Assoc. for Rental of Legacy Center

            Mike Moake, Davis County Legacy Events Center Marketing, presented the following agreements for North American Grappling Association to rent the Legacy Center for wrestling grappling tournaments: 

            Agreement #2011-367 for September 21-22, 2012 for a receivable of $2,550.00. 

            Agreement #2011-368 for March 2-3, 2012 for receivable of $1,200.00.

Commissioner Millburn made a motion to approve both agreements.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2011-369 & #2011-370 for ZD Roping for Rental of Legacy Center

            Mike Moake presented the following agreements for ZD Roping to rent the Legacy Center for cattle roping events:

            Agreement #2011-369 for December 30, 2011 – January 2, 2012 for a receivable of $2,260.00.

            Agreement #2011-370 for May 25 – May 28, 2012 for a receivable of $2,860.00. 

Commissioner Millburn made a motion to approve both agreements.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

 

            Commissioner Petroff made a motion to convene as the Board of Equalization.  Commissioner Millburn seconded the motion.  All voted aye.

Property Tax Register Approved

            Ross Bartholomew, Davis County Tax Administration Director, presented the property tax register.  The register reflects 58 items for approval.  Commissioner Millburn made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.

 

            Commissioner Millburn made a motion to reconvene the regular commission meeting.  Commissioner Petroff seconded the motion.  All voted aye.

Check Registers Approved

            Check registers as prepared by the Davis County Clerk/Auditor’s Office were approved with a motion from Commissioner Petroff.  Commissioner Millburn seconded the motion.  All voted aye.  Documents on file in the office of the Davis County Clerk/Auditor.

 

Commission Comments:

            Commissioner Petroff stated Thanksgiving was a great holiday with family and friends.  We have a great country.
