COMMISSION MEETING MINUTES

January 3, 2012

 

            The Board of Davis County Commissioners met in room 236 of the Davis County

Courthouse, Farmington, Utah on January 3 at 10:00 a.m.  Members present were Chairman Bret Millburn, Commissioner Louenda H. Downs, Commissioner John Petroff, Jr., Clerk/Auditor Steve S. Rawlings, Chief Deputy Civil Attorney Bill McGuire, and Deputy Clerk/Auditor Linda May.

 

            Ross Bartholomew, Davis County Tax Administration Director, lead the Pledge of Allegiance.  All were invited to stand and join in.

Press Release for New Procedure for Business Personal Property Tax Reporting

            Dennis Yarrington, Davis County Assessor, read the following press release:

            The Davis County Assessor, in order to streamline the procedures in his office, has announced a time and money-saving exempt filing method for a little over one third of those businesses who report annually to the Assessor’s office for personal property tax.

 

            The one page abbreviated form and application for exemption will be mailed to about 5,500 business owners who have been under the exempt limit for the past two consecutive year (2010 & 2011) – these are the only accounts that qualify (the exception to this is those business owners who have never provided a list of personal property to the Assessor).

 

            Estimated time to file?  It should take only a couple of seconds!  This should save the average qualifying business owner at least a couple of hours.  It will also save time and money for the Assessor’s office:  How?  No files to compare to last year…no dropping of sold personal property or adding of new property…just sign the letter indicating that no significant increases of personal property have been added by the business over the past year and mail it in…

 

            This assumes, of course, that no significant purchases of personal property have taken place.  Those who fall under the exempt amount for 2011 & 2012 will receive the same letter next year (2013).  However, the following year (2014) will be an “audit” year and they will be required to go through the full filing process.  If they still qualify, they’ll receive only the one page letter exemption form for the succeeding two years.

 

            This is an innovative move to comply with the law, but save all involved significant time and money.  The new exempt filing method does not clear/remove any tax bills that exist from previous years.

 

Dennis reiterated this process does not remove the tax bill.  The new one page exempt form was also distributed.  The intended effect is to save time for the business owners and the Assessor’s Office.  Steve Rawlings, Davis County Clerk/Auditor, thanked Dennis for looking at the cost savings and efficiency. 

Ordinance

 #8-2011 Animal Control Stands as Presented at December Commission Meeting

            Clint Thacker, Davis County Animal Control Director, stated that at commission meeting on December 20 amended ordinance #8-2011 for Animal Control was presented.  The questions that were raised have been reviewed by the Davis County Attorney’s Office and the ordinance stands as was presented.  Chairman Millburn commented that no changes have been made to the ordinance as previously presented.  It is ready to be acted upon and to move forward.  Chairman Millburn asked Clint about the process.  Clint confirmed that Animal Control Officers will not be going door to door to look for unlicensed cats.  We want this to be an education based process.  During this first year of implementation all late fees will be waived to help facilitate the licensing of cats.  Cities will now need to approve the ordinance at their city council.  They can help by putting the information in their city newsletter, notes on the utility bills, and post notices throughout the county.  Commissioner Downs stated the intent is to get cats back to owners as we do not want them left at the shelter.  Clint stated that the cats at the shelter not returned or adopted had a euthanized rate of 84%.  It is something we do not want to do.

 

 

Amendment #2009-246A Paul Justin Manning to Serve as Veterinarian at Animal Shelter

            Clint Thacker, Davis County Animal Control Director, presented amendment #2009-246A with Paul Justin Manning, DVM.  He will serve as the veterinarian for Davis County Animal Care and Control.  During this past year he has been at the shelter two days a week and will now come Monday, Wednesday, and Friday in 2012.  It is a payable of $55.00 per hour.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-3 Randy Kelly to Serve as Hearing Officers

            Ross Bartholomew, Davis County Tax Administration Director, presented the following three agreements for individuals to serve as hearing officers for the Board of Equalization:

            Agreement #2012-1     Douglas G. Miller        Payable of $37.50/Hourly

            Agreement #2012-2     Terry Coon                  Payable of $37.50/Hourly

            Agreement #2012-3     Randy Kelly                Payable of $45.00/Hourly (commercial)

Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-4 Golden Spike Dog Obedience Club for Funding for Shade Trees at Dog Park

            Megan Hatch, Davis County Legacy Events Fair Coordinator, presented agreement #2012-4 with Golden Spike Dog Obedience Club.  This is a sponsor agreement with Golden Spike Dog Obedience Club to sponsor the Legacy Events Center Dog Park shade trees.  Their sponsorship of these trees will be noted on signs outside of the main gates of the park.  The trees will provide much needed shade for patrons of the park.  It is a receivable value of $800.00.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

License Application #2012-5 to Farmington City for Business & Beer

            Dave Hansen, Davis County Legacy Events Director, presented the business license renewal and beer license renewal application #2012-5 to Farmington City Corporation. It is a payable of $375.00.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.  

Change Order #2011-249A ACME Construction for Additional Costs for Stone Creek Box Culvert

            Kirk Schmalz, Davis County Public Works Director, presented change order #2011-249A with ACME Construction.  It is for additional costs related to materials and labor for the Stone Creek Box Culvert on Pages Lane.  The project involved repairs under I-15.  It is a payable of $43,000.00.  This is for a project costing over one million dollars.. Unfortunately, most of the work is underground and cannot really be seen.  At one time, there were three difference contractors working on projects in the same area.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Certificate of Substantial Completion for ACME Construction

            Kirk also presented the Certificate of Substantial Completion for ACME Construction.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-6 National Medical Education & Trng Center Inc for Students Ride along

            Kevin Fielding, Davis County Sheriff’s Office, presented agreement #2012-6 with the National Medical Education & Training Center, Inc. and the University of Texas Health Science Center to allow students to ride along with paramedics.  No cost is involved.  It is a two-year contract. Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-7 Easements with Jill & Jim Puffer

            Tony Thompson, Davis County Planning Office, presented agreement #2012-7 to finalize and accept the granting of easements with Jill Puffer and Jim Puffer, Trustees or their successors in trust, under The Jill Puffer Living Trust, dated January 31, 2005, for the North Holmes Creek Culvert Improvement Project (tax ID 11-641-0003) at 528 North 900 West, Kaysville, UT.  On this property there are 3 easements:  a permanent easement, an access easement, and a temporary construction easement.  It is a payable of $45,000.00.  Commissioner Downs made a motion to accept the grant of easements and authorize recording of the same.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.                   

Amendment #2009-168G UT Dept of Human Service for Increased Funding

            Chairman Millburn presented amendment #2009-168G with the Utah Department of Human Services.  It is to increase funding for state fiscal year 2012 for Adult Outplacement and Diversion – Mental Abuse (pass through to Davis Behavioral Health) in the amount of $55,444.00.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Nominations for Weber Basin Water Conservancy District

            Chairman Millburn stated that in accordance with Section 17B-2a-1005, UCA, Davis County was requested by Weber Basin Water Conservancy District to nominate three individuals for consideration to serve on the Board of Directors for the District.  The three individuals named were John Petroff, Jr.; P. Bret Millburn; and Jewel Lee Kenley.  The names are required to be forwarded to the Governor of Utah for one of the three to be nominated to the Board for a 4-year term.  Due to time sensitivity the names were forwarded at the end of December.  Commissioner Downs made a motion to ratify the names of the nominees from Davis County.  Commissioner Petroff seconded the motion.  All voted aye.

Property Tax Approval

            Ross Bartholomew, Davis County Tax Administration Director, presented the property tax register.  The register reflects 245 items for approval.  As of December 31 there were zero items to be worked by the appraisers.  Commissioner Downs made motion to approve the register.  Commissioner Petroff seconded the motion.  All voted aye.

 

 

           

            Commissioner Downs made a motion to reconvene the regular commission meeting.  Commissioner Petroff seconded the motion.  All voted aye.

Commission Meeting Minutes Approved

            Commissioner Petroff made a motion to approve the commission meeting minutes for the December 6, 2011 10:00 am meeting and the minutes of the December 6, 2011 pm public hearing.  Commissioner Downs seconded the motion.  All voted aye.

Check Registers Approved

            Check registers as prepared by the Davis County Clerk/Auditor’s Office were approved with a motion from Commissioner Downs.  Commissioner Petroff seconded the motion.  All voted aye.  Documents are on file in the office of the Davis County Clerk/Auditor.

 

Commission Comments:

            Commissioner Downs complimented Ross Bartholomew for the hard work with the Assessor’s Office, Clint Thacker for all the work with animals; Tony Thompson, for handling the many issues to do with properties; Kirk for the hard work of catching and keeping up with Public Works projects; and Kevin Fielding for all the services provided by the Sheriff’s Office.  We provide services in the best way we can and we have a great group of citizens we get to serve.

            Commissioner Petroff also thanked Ross Bartholomew and Dennis Yarrington.  We had fewer tax appeals for 2011.  It is good to be able to streamline the personal property tax process for businesses.  The Davis County Clerk/Auditor’s Office and Attorney’s Office provide good service as well.

 

Public Comments:

            Frank Simmons, Layton City.  He stated he is opposed to licensing of cats.  He feels it is a problem that doesn’t exist.  He asked for the ordinance to not be passed.

            Debbie Barlow, Clinton City.  She expressed concern about officers who subjectively decide about the care of animals while in the field.  It then takes time and money for animals to be returned.

            Commissioner Downs stated the commission is open to your views.  If there is a better way let us know.  Suggestions are welcome and we want to hear ideas.

            Commissioner Petroff stated that there has been much discussion with the cities.  We want people to be responsible pet owners.  The effectiveness of the plan will not really be known until year end.
