COMMISSION MEETING MINUTES

January 24, 2012

 

            The Board of Davis County Commissioners met in room 236 of the Davis County

Courthouse, Farmington, Utah on January 24 at 10:00 a.m.  Members present were Chairman Bret Millburn, Commissioner Louenda H. Downs, Commissioner John Petroff, Jr., Clerk/Auditor Steve S. Rawlings, Chief Deputy Civil Attorney Bill McGuire, and Deputy Clerk/Auditor Linda May.

 

            Barry Burton, Davis County Planning Director, led the Pledge of Allegiance.  All were invited to stand and join in.

Recognition of Robin Kruger for Service as Charity Campaign Chairman for Davis County

            Chairman Millburn invited Robin Kruger, Davis County Personnel, to come forward.  Robin has served for many years as the Charity Campaign Chairman for Davis County which involves the collection of donations for United Way, Community Shares, and Community Health.  Despite the challenging economy, 233 employees pledged to donate $28,331.00 during the recent campaign drive for 2012.  Robin a few years ago came up with an idea of doing a soup cook-off in November.  It is a very popular idea with employees.  Employees can sign up to bring a variety of soups, breads, or deserts.  The winner for each category wins a $25.00 gift card.  The employees who just want to attend the luncheon are asked to make a $5.00 donation.  Cookbooks of recipes current and past were offered for $5.00.  The luncheon raised $345.00 for the food bank.  So far the cookbook sales raised $280.00 for donation to the food bank.  Also employees were encouraged to donate food items to the food bank.  The commissioners thanked Robin for all her efforts and presented to her a Community Services Recognition Certificate.

            Robin thanked the Commissioners, Department Heads, Department Campaign Chairs, and Stacey Adams (Personnel Office) for the support and assistance.  Mel Miles, Davis County Personnel Director, complimented Robin on all that she accomplishes as she has a very busy schedule but is very committed.  The Annual Soup Cook-Off was totally Robin’s idea.

Open House at New CJC Facility

            Chairman Millburn announced the Children’s Justice Center Open House this Friday, January 27 from 11:00 am – 3:00 pm.  People are welcome to tour the facility and learn more about the work done at the CJC.

CAFR Award to  Davis County for 18th Year in a Row

            Steve Rawlings, Davis County Clerk/Auditor, stated he was not on agenda but was very excited to make the announcement that Davis County has been awarded the Government Office of Financial Accounting Award for Excellence in Financial Reporting for the 18th year in a row.  The information was conveyed to the Clerk/Auditor’s Office late yesterday afternoon.  Congratulations are in order for the sound financial status of Davis County.  Steve expressed appreciation to the support of the Commissioners, other Elected Officials, and Department Heads.  Steve also introduced the financial team from the Clerk/Auditors Office who assists with preparing the Comprehensive Annual Financial Report:  Jonathan Lee, Doug Stone, Terry Tremea, Curtis Koch, and LynnAnn Winterton.  There are only three counties in Utah who have received the award:  Davis, Weber, and Salt Lake.  We are a full disclosure county.  The audit report is clean.  It is available to everyone.

            Commissioner Petroff stated that around the country disclosure is a big issue.  The report allows for the reading of numbers and history of the County.  I express appreciation for the efforts.

            Commissioner Downs stated that Davis County is the poster child for the award.  I use the CAFR often.  WOW and thanks again.

Planning Commission Board Appointment

            Barry Burton, Davis County Planning Director, presented the name of David Fjeldstead to be reappointed to the Davis County Planning Commission.  His term of office officially ended June 30, 2011, but he had indicated a desire to continue to serve.  He is an entrepreneur and developer who is thoughtful, willing to express his opinions and works well with the other members and staff.  I would recommend Dave be reappointed for one more term to end June 30, 2015.  Commissioner Downs made a motion to approve stating the historical knowledge with the county is valuable.  Commissioner Petroff seconded the motion.  All voted aye.

 

            Barry Burton, Davis County Planning Director, presented the following two change orders:

Change Order #2011-75A Earthtech Engineering, Inc. for Additional Costs for Admin/Library/CJC

            Change order #2011-75A with Earthtec Engineering, Inc. for the Davis County Administration/Library/Children’s Justice Center for additional costs related to construction alterations, change in material type, welding and bolting re-inspections, additional soil compactions, additional geotechnical observations and consultations, and weather delays.  Barry stated the company is keeping costs as low as they can.  It is a payable of $8,985.00.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Change Order #2010-409D Wadman Corp for Additional Costs for Admin/Library/CJC

            Change order #2010-409D with Wadman Corp for the Davis County Administration/Library/Children’s Justice Center for additional costs related to change in grade of steel (from 20 gauge to 16 gauge), costs for drilling of the geo-thermal wells (4 times as long as anticipated because of soil issues), intrusion detection for CJC and Library (electrical), plumbing (smoke dampers), backfill for Administration Building site, and other miscellaneous items.  It is a payable of $285,385.02.  Chairman Millburn stated the changes have been thoroughly reviewed by the architect, builder, and county personnel.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Amendment #2011-2A UT Dept of Health Funding for ARRA Healthy Child Care Initiative and Budget Change

            Diana Reich, Davis County Health Administration, presented amendment #2011-2A with the Utah Department of Health to extend the date of contract through August 2, 2012 and increase funds by $13,434.66.  It is for the ARRA Healthy Child Care Initiative to be used in licensed child care facilities, home, and Head Start Centers for planning activities and meals.  The increase funding requires a budget change to increase line item 11-3340-800 ARRA Child Care Initiative by $13,434.66; increase line item 11-4980-110 Payroll by $5,500.00; increase line item 11-4980-130 Benefits by $3,250.00; increase line item 11-4980-230 Travel by $500.00; increase line item 11-4980-231 Mileage by $1,500.00; increase line item 11-4980-250 Operating Supplies by $1,500.00; and increase line item 11-4980-610 Misc. Supplies by $1,184.66.  Commissioner Downs made a motion to approve the amendment and the budget change.  Commissioner Petroff seconded the motion.  All voted aye.  Documents on file in the office of the Davis County Clerk/Auditor.

Budget Change for MSA Funding for the Health Department

            Diana Reich also presented the budget change that was held from last week’s commission meeting.  It is to increase MSA funding (amendment #2010-215A).  The budget change is to increase line item 15-3340-027 MSA FDA Enforcement by $3,299.66; increase line item 15-3340-027 MSA CDC Enforcement by $6,129.81; increase line item 15-3340-023 MSA by $19,943.99; and increase line item 15-4315-610 Misc. Expenses by $29,373.46.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Grant Application #2012-27 UT Dept of Health for Purchases of Video Laryngoscopes and Vehicle

            Kevin Fielding, Davis County Sheriff’s Office, presented grant application #2012-27 with the Utah Department of Health/Bureau of Emergency Medical Services and Preparedness.  The application is in the amount of $28,200.00.  If awarded, a budget change will be required.  The internal due diligence has been completed and reviewed with the budget committee.  If awarded, the funds would be used to purchase video laryngoscopes, and a replacement vehicle.  Commissioner Petroff made a motion to submit the grant. 

 

 Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-28 UT Division of Facilities Management for Sale of a Section of Justice Complex to the State of Utah

            Curtis Koch, Davis County Procurements and Contracts, presented agreement #2012-28 with the Utah Division of Facilities Management.  A previous contract #1990-202 section 22 gives the State of Utah the option to purchase a section of the Justice Complex and parking space on the site..  The agreement before you designates the area for purchase for a receivable of $3,788,219.00.  This negotiation has been thoroughly reviewed by State personnel and county personnel.  Chairman Millburn stated it has taken a lot of time as one question seemed to lead to 10 more questions.  The areas affected are the Attorney’s Offices and certain access of the Sheriff’s Office.   It is retroactive to January 1, 2012.  Davis County will now become the leasee for the space needed for employees.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.  Steve Rawlings, Davis County Clerk/Auditor, stated that this is one- time money that could be used for capital improvements.    

Presentation for DACVB Dining Guide and Mobile Website for Davis County Restaurants as Recommended by TTAB and Necessary Budget Change

            Kent Sulser, Davis County Community and Economic Development Director, introduced Barbara Riddle, Davis Area Convention and Visitor’s Bureau, CEO.  Barbara also welcomed Kathy Dysert, DACVB Sales/Marketing, to the meeting.  The Davis County Tourism Tax Advisory Board (TTAB) met on December 8, 2011 to hear a presentation and a request for funding from the Davis Area CVB for a Davis County Dining Guide and creation of a DACVB mobile website.  The TTAB voted unanimously to ask the Commission to approve a request for $11,983.00 from Tourism Funds.  Barbara showed a power point discussing the “APP” that could be used for Smartphone’s and iPads for a free download application that would help direct visitors, hotel guests, conference center attendees and local citizens with restaurant information.  This idea is supported by the Davis Conference Center, hoteliers and restaurateurs in and around Layton City area and by Davis County Community and Economic Development.  The purpose is to highlight restaurants and continue to grow tourism in Davis County.   The mobile site is being designed to ensure ease of information update between both the mobile site and the standard website, www.davis.travel.  The Dining Guide being prepared would be inclusive of every restaurant located within the county and for the ease of the consumer, would be listed by city, cuisine and in one of four geographical zones, South Davis, Middle Davis, Layton, and North Davie.  There would be 5,000 copies of the 4” x 9” 44-page guide printed and distributed throughout the county mainly via hotels, facilities and attractions. This was not a budgeted item at the time the budget for 2012 was approved; therefore, a request for additional funds is requested in the amount of $11,983.00.  Barbara stated the goal is to be ready to roll with this by the end of February.

            Steve Rawlings, Davis County Clerk/Auditor, stated in December the tourism revenue was reviewed.  At the January 20 DACVB year-end report given at the Castle in Layton, it was up 2.10% from the projected which is higher than expected.

            Commissioner Downs stated the tourism tax revenue comes from restaurants, lodging, and car rentals in Davis County.

                        Kent Sulser, Davis County Community and Economic Development Director, presented the following budget change for approval:  Decrease line item 18-2951-00 Tourism Fund Balance by $11,983.00 and increase line item 18-4192-289 CVB by $11,983.00 for the purpose of a Davis County Restaurant Guide and mobile site development.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

 

            Commissioner Downs made a motion to convene as the Board of Equalization.  Commissioner Petroff seconded the motion.  All voted aye.

Property Tax Register Approved

            Ross Bartholomew, Davis County Tax Administration Director, presented the property tax register.  The register reflects 74 items for approval.  The remaining 44 items are in process for final completion.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye. 

 

            Commissioner Petroff made a motion to reconvene the regular commission meeting.  Commissioner Downs seconded the motion.  All voted aye.

Commission Minutes Approved

            Commissioner Petroff made a motion to approve the commission meeting minutes of January 3, 2012.  Commissioner Downs seconded the motion.  All voted aye.

Personnel Register Approved

            Commissioner Downs made a motion to approve the personnel register.  Commissioner Petroff seconded the motion.  All voted aye.

            Check registers as prepared by the Davis County Clerk/Auditor’s Office were approved with a motion from Commissioner Petroff.  Commissioner Downs seconded the motion.  All voted aye.  Documents are on file in the office of the Davis County Clerk/Auditor.
