COMMISSION MEETING MINUTES

February 28, 2012

 

            The Board of Davis County Commissioners met in room 236 of the Davis County

Courthouse, Farmington, Utah on February 28 at 10:00 a.m.  Members present were Chairman Bret Millburn, Commissioner Louenda H. Downs, Commissioner John Petroff, Jr., Clerk/Auditor Steve S. Rawlings, Deputy Civil Attorney Neal Geddes, and Deputy Clerk/Auditor Linda May.

 

            Clint Thacker, Davis County Animal Control Director, led the Pledge of Allegiance.  All were invited to stand and join in.

Grant Application #2012-61 UT Dept of Justice for Funding for DUI Drug Court

            Jim Kelly, Davis County Attorney Office, presented grant application #2012-61 to the US Department of Justice (DOJ), Office of Justice Programs (OJP), Bureau of Justice Assistance (BJA).  The funding is being requested for the DUI Drug Court.  In the past, the county has pursued funding through the Utah Department of Public Safety but that funding source is no longer available.  Davis County is requesting Drug Court Discretionary Grant Program Funds in the amount of $200,000 to enhance the current Adult Felon DUI Court to assist non-violent offenders with successful rehabilitation from the use of drugs and/or alcohol. The primary goal is to terminate the DUI behavior of twenty new non-violent felony DUI offenders each year.  The goal is to reduce the recidivism rate of this population and allow the offender to return to a more meaningful and productive lifestyle.  A felony DUI charge results when a defendant has three DUI convictions within a ten-year time period.  As this third conviction is a felony, it is adjudicated through the 2nd District Court.  The Felony DUI Court program is managed through the Davis County Attorney’s Office, all felony DUI offenders can be referred to the program for screening and evaluation and admission to the program.  In evaluating these non-violent felony DUI offenders, it was determined that a number of this population differed from the “traditional” Drug Court client in that on average they are older, more established and socially stable, employed, and generally have a better support system.  In their own minds, they are not of the criminal “bent” of those with drug addiction.  Through a partnership with the criminal justice system and the treatment community, treatment intervention will be structured around the authority and personal involvement of a single Felony DUI Court Judge.  This court creates a non-adversarial courtroom atmosphere where the Judge and a dedicated team of court officers and staff work towards the common goal.  Trackers monitor the activities of the individuals and individuals must report to the judge weekly.  80 – 85% of the individuals who commit to the program complete it.  The program is effective as a cost reduction and reduces recidivism.  If the grant is received the local match is $66,667.00. 

            Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.  The commissioners thanked Jim Kelly and Teresa Kendell for their work with the program and the Mental Health Court.  Steve Rawlings, Davis County Clerk/Auditor, stated the program does save money.

Agreement #2012-62 Travis Peterson for Training of Detectives & CPS Investigators for CJC

            Susan Burton, Davis County Children’s Justice Center, presented agreement #2012-62 with Travis Peterson.  He provides training and feedback to detectives and CPS investigators who conduct forensic interviews at the CJC.  The design is to develop the highest possible skill set for forensic interviewers and also to increase the expertise of each interviewer.  This is his second year for being on contract with the county.  It is a payable of $5,000.00.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Amendment #2009-58C Farmington City

Amendment #2009-109C for Centerville City for Animal Control Services

            Clint Thacker, Davis County Animal Care and Control Director, presented two amendments for Davis County to provide animal control services for the following cities:

            Chris Sanford, Davis County Library Director, presented the following agreements:

Agreement #2012-63 George Guidall to Speak at South Branch Library

            Agreement #2012-63 with George Guidall.  He will be the featured speaker on April 12, 2012, at the South Branch Library.  The speaking performance is titled “The Art and Artifice of Audio book Narration.  It is a payable of $2,000.00.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-64 Karen Eddington to Speak at Central Branch Library

            Agreement #2012-64 with Karen Eddington.  She will be the featured speaker on April 28, 2012 at the Central Branch Library.  The speaker presentation is “A Positive U:  Popularity vs. Self-Acceptance”.  It is a payable of $100.00.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-65

 J. Willard Marriott Library to Digitize Davis County Clipper

            Agreement #2012-65 with J. Willard Marriott Library, University of Utah, Digital Technologies Division to digitize the Davis County Clipper from May 9, 1975 thru December 31, 1978.  It is a payable of

$10,032.00.    Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-66 Syracuse City to Allow Use of Syracuse Community Center by Library

            Agreement #2012-66 with Syracuse City for use of the Syracuse Community Center for the Library’s Summer Reading Program.  The fee is waived.  The number attending can be 300 to 400 and the Syracuse Library does not have the space to accommodate so many. Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Health Board Appointment

            Diana Reich, Davis County Health Department, stated the Davis County Board of Health is recommending the name of Scott Zigich, Davis School District, to be appointed to the Davis County Board of Health to fill the Davis County School District vacancy.  Mr. Zigich has expressed an interest in serving and the Board believes that his activities and contributions will be very valuable to the Board and the citizens of Davis County.  Commissioner Downs stated she is acquainted with Scott Zigich and made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  The term will run until July 31, 2015.

Agreement #2012-67 UT Dept of Comm. & Culture to Fund Electric Base Load Reduction Services

            Diane Reich presented agreement # 2012-67 with the Utah Department of Community and Culture.  It is for funding up to a maximum of $30,000.00.  It is to provide electric base load reduction services to low-income households served by Rocky Mountain Power from March 1, 2012 thru February 28, 2013.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Application #2012-68 for On Premise Beer Retail License (Recreational)

            Dave Hansen, Davis County Legacy Events Director, presented the application #2012-68 for an “On Premise Beer Retail License (Recreational)” for the Utah Department of Alcoholic Beverage Control.  It is a new type of license designed to fit a recreational facility like a fair grounds.  It replaces our old beer license.  The State has waived our fees and some of the general requirements because we are a government agency.  The period of the license would be from March 2012 to March 2013.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Change Order #2010-409E Wadman Corp for changes for Administration/Library/CJC Project

            Barry Burton, Davis County Planning Director, presented change order #2010-409E with Wadman Corp.  The necessary changes relate to the Administration/Library/CJC project.  The changes are for many items such as a change to make the reception desk at the front entrance of the CJC built in place, wall coverings in the interview rooms, a gate for fence, concrete, millwork, electrical, smoke detector for the downstairs area, front door key pad and a larger sink.  The costs come to a total payable of $43,099.79.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Amendment #2010-198B UT Dept of Human Services for Pass thru Funds to DBH for Family Resource Facilitators Program

            Chairman Millburn presented amendment #2010-198B with the State of Utah, Department of Human Services, Division of Substance Abuse & Mental Health.  The funding in the amount of $8,748.00 will be pass thru to Davis Behavioral Health for the “Family Resource Facilitators Program.  It also extends the date until June 30, 2013; replaces the rate table; and FY 2013 budget forms.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Budget Change for Davis Conference Center

            Steve Rawlings, Davis County Clerk/Auditor, presented a budget change to increase line item

18-4192-285 DCC FFE by $60,000.00 and decrease line item 18-2951-000 by $60,000.00.  The budget change in required for the expenditure to upgrade the audio system at the Davis Conference Center.  Commissioner Petroff explained the area being upgraded is the expo area and was original not planned for all the types of meetings and events being held in the area.  This will improve the effectiveness of the system.  Steve Rawlings, Davis County Clerk/Auditor, commented the funds are from a reserve fund built up for the FFE of the conference center.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor

 

            Commissioner Downs made a motion to convene as the Board of Equalization.  Commissioner Petroff seconded the motion.  All voted aye.

Property Tax Register Approved

            Ross Bartholomew, Davis County Tax Administration presented the property tax register.  The register reflects 24 items for approval.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.

 

            Commissioner Downs made a motion to reconvene the regular commission meeting.  Commissioner Petroff seconded the motion.  All voted aye.

Commission Minutes Approved

            Commissioner Petroff made a motion to approve the commission meeting minutes of February 14, 2012.  Commissioner Downs seconded the motion.  All voted aye.

Check Registers Approved

            Check registers as prepared by the Davis County Clerk/Auditor were approved with a motion from Commissioner Downs.  Commissioner Petroff seconded the motion.  All voted aye.  Documents on file in the office of the Davis County Clerk/Auditor.
