COMMISSION MEETING MINUTES

March 6, 2012

 

            The Board of Davis County Commissioners met in room 236 of the Davis County

Courthouse, Farmington, Utah on March 6 at 10:00 a.m.  Members present were Chairman Bret Millburn, Commissioner Louenda H. Downs, Commissioner John Petroff, Jr., Clerk/Auditor Steve S. Rawlings, Chief Deputy Civil Attorney Bill McGuire, and Deputy Clerk/Auditor Linda May.

 

            Richard Maughan, Davis County Recorder, led the Pledge of Allegiance.  All were invited to stand and join in.

Certificates of Recognition from the International Association of Fairs & Expositions Consumer Protection Workshop

            Dave Hansen, Davis County Legacy Events Center Director, and Larry Hearn, Davis County Legacy Events Center Grounds and Maintenance Supervisor, were asked to come forward.  Dave stated the two attended a workshop to learn more about the pathogen contamination from E-Coli and other enteric pathogens.  It was an International Association of Fairs & Expositions Consumer Protection Workshop in Salt Lake City.  Contamination from E. Coli and other enteric pathogens continues to pose a tremendous risk to all fair, festival, and event guests that interact with animals in livestock barns, petting zoos, birthing centers, etc.  A questionnaire was handed out at the conference and it was a pleasant surprise to find out how many of the safety measures are already being taken at the Legacy Events Center.  Examples are creating proper signage, installing hand-wash areas and establishing specific cleaning protocols.  Dave was proud to say Davis County is a leader and a trend setter.  A lot goes into preparations for the fair and behind the scenes.  Both Dave and Larry were awarded very nice certificates of recognition from the workshop.  The commissioners expressed appreciation for the efforts to help promote the fair as a healthy family activity. 

            Dave said he is often asked, “Well what do you do the rest of the year?”  He said, “The staff is always busy as there are over 800 rentals of the facilities throughout the year.”

Read-a-thon for Davis County Library March 16, “Lost in Outer Space”

            Chris Sanford, Davis County Library Director, introduced Laurel Pederson, Davis County Library Youth Coordinator.  Laurel excitedly talked about the upcoming “Lost in Outer Space” Read-a-thon on Friday, March 16 at 6:30 – 8:30 pm.  The events include storytelling, astronaut training (obstacle course), build your own robot, experience a meteor crash, black holes, and much more fun for the entire family.  “Milky Way” treats will be given out.  Events will be held at the North Branch Library in Clearfield, South Branch Library in Bountiful, and Central Branch Library in Layton. 

 

            Chris Sanford, Davis County Library Director, presented the following two agreements

Agreement #2012-70 Ogden Astronomical Society to Participate at Read-a-thon

            Agreement #2012-70 with the Ogden Astronomical Society.  They will provide an astronomy presentation at the Central Branch Library on March 16 as part of the read-a-thon.  There is no cost.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-81 Clark Planetarium for Summer Reading Program

            Agreement #2012-81 with Clark Planetarium for the star show for the Summer Reading Program.  It is a payable of $800.00.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-71 Corelogic Solutions, LLC for Ownership Plats

            Richard Maughan, Davis County Recorder, presented agreement #2012-71 with Corelogic Solutions, LLC.  It the annual commercial license purchase of county ownership plats for calendar year 2012.  They will make the information available on their website.  It is a receivable of $2,000.00. Commissioner Downs made

 

 motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Approval of Revisions to Personnel Policies

            Mel Miles, Davis County Personnel Director, presented revisions to the following personnel policies #100 – Definitions; #130 - Sick Leave; #160 – Retirement; #260 – Performance Appraisal; and #400 Classification Adjustments.  Most of the proposals are small tweaks.  The additions/revision in the Definitions and Retirement policies are required by URS rule changes.  The changes in the other policies are designed to clear up some confusion and contradictory language to align provision with current practice.  Also is recommended to delete the School Nursing Alternative Schedule policy altogether since the program no long exists.  The Davis County Attorney’s Office and the Davis County Employees Association President have reviewed the recommended changes and concur.  Commissioner Petroff made a motion to approve the recommended changes.  Commissioner Downs seconded the motion.  All voted aye. New revisions will be sent to each department.

Agreement #2012-72 Robert Hilton for Consulting Services for Visual Studio

            Mark Langston, Davis County Information Systems Director, presented agreement #2012-72 with Robert Hilton.  He is a Weber State University professor and will assist with training for Visual Studio.  He will be re-tooling the language for 11 programmers in the Information System Department and providing consulting services.  This will enhance tools as they pertain to application for the web. Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Notice of Award for Staker/Parson Companies for Causeway Overlay or Surface Seal

            Kirk Schmalz, Davis County Public Works Director, presented the Notice of Award for Staker/Parson Companies for the Causeway Overlay or Surface Seal.  After review of the budget it has been decided to go with the 2” overlay for a payable of $1,144,770.  It is felt the difference from the projected budget of $1,000,000 will be made up from the B Roads Fund.  It is important to provide the longevity of use with the 2” overlay.  The temperature has to be at a certain point before the resurfacing can be done.  It should be approximately May 15 when the contract is signed.  It will take approximately two weeks to complete and will begin after the Memorial Day weekend.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-78  Big Brothers/Big Sisters of Utah

             Greg Johnson, Davis County Planning Office, presented the following agreements for sub-grantee agencies to receive CDBG funds (pass thru) for projects and services:

·          Agreement #2012-73 with Bountiful Community Food Pantry for purchase of a van, equipment purchases and salaries for the food pantry in the amount of $36,475.00.

·         Agreement #2012-74 with Bountiful Community Food Pantry for construction costs associated with the purchase and installation of a cardboard baler and an emergency electrical generator for the food pantry in the amount of $42,935.00.

·         Agreement #2012-75 with Davis Behavioral Health for the acquisition of residential housing to provide affordable housing for low-income residents to be operated by Davis Behavioral Health.

·         Agreement #2012-76 with Davis Applied Technology College to purchase a nursing simulation manikin in the Virtual Healthcare Nursing Lab operated by the Davis Applied Technology College.

·         Agreement #2012-77 with Davis Community Housing Authority to fund a down payment assistance program and for the emergency repair program operated by the Davis Community Housing Authority in the amount of $150,000.00.

 

·         Agreement #2012-78 with Big Brothers/Big Sisters of Utah, Inc. for operational expenses of the Community-Based Mentoring Program in Davis County, operated by Big Brothers/Big Sisters of Utah, Inc. in the amount of $5,600.00.

Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Documents on file in the office of the Davis County Clerk/Auditor.   Commissioner Petroff reminded everyone that previously a contract with the Family Connection Center to receive CDBG money was approved for a new roof that was needed because of the December , 2011, windstorm damage.

 

            Kevin Fielding, Davis County Sheriff’s Office, presented the following:

Annual Certification Statement #2012-79 UT Dept of Human Services

            Articles of Annual Certification Statement and Conflict of Interest Certification #2012-79 for the Utah Department of Human Services/Office of Recovery Services.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.  

Agreement #2012-80 Johnson Controls, Inc. for HVAC Services at Justice Complex

            Agreement #2012-80 with Johnson Controls, Inc. for the HVAC service agreement for specified areas at the justice complex.  It is a five-year contract for a payable of $43,068.00.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.  

Budget Changes for Davis County Sheriff’s Office

            Steve Rawlings, Davis County Clerk/Auditor, presented a budget change for the sheriff’s office for a grant received from Sorenson Legacy Foundation in the amount of $11,825.00.  The Foundation’s Board approved the funds in support of the Pre-hospital Rapid Sequence Intubation pilot program.  It is to increase line item 10-3870-000 Contribution Private by $11,825.00 and increase line item 10-4210-740 Equipment by $11,825.00 for the purchases.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Amendment #2011-231A UT Dept of Human Services for Changes to Contract

            Chairman Millburn presented amendment #2011-231A with the Utah Department of Human Services, Division of Substance Abuse and Mental Health.  It is to correct the contract language regarding: (1) funding; (2) matching funds; and (3) non-federal match.  Chairman Millburn made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor. 

Budget Change for Capital Projects

            Steve Rawlings, Davis County Clerk/Auditor, presented a budget change to decrease line item

10-4150-910 General Fund Transfer Out by $500,000.00, increase line item 42-3820-000 Capital Projects Transfer In by $500,000.00, and increase line item 42-4250720 Capital Project Construction by $500,000.00.  The money is from the PEHP Insurance Rebate after the amount was rebated to employees for two successive pay periods reflective of their insurance payment.  This is one-time money.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

 

            Commissioner Downs made a motion to convene as the Board of Equalization.  Commissioner Petroff seconded the motion.  All voted aye. 

Property Tax Register Approved

            Ross Bartholomew, Davis County Tax Administration Director, presented the property tax register.  The register reflects 3 items for approval.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.

 

            Commissioner Petroff made a motion to reconvene the regular commission meeting.  Commissioner Downs seconded the motion.  All voted aye.

 

Commission Minutes Approved

            Commissioner Petroff made a motion to approve the commission meeting minutes of February 21 and 28, 2012.  Commissioner Downs seconded the motion.  All voted aye.

Check Registers Approved

            Check registers as prepared by the Davis County Clerk/Auditor’s Office were approved with a motion from Commissioner Petroff.  Commissioner Downs seconded the motion.  All voted aye.  Documents on file in the office of the Davis County Clerk/Auditor.

 

Commission Comments:

            The commissioners congratulated Steve Rawlings on his grandson’s winning points at the basketball State 1-A championship game of Layton Christian Academy.  It was amazing to read the newspaper article of the game and Remington Rawlings incredible performance which gave the team their win.  Steve stated that he is very proud of Remington and his grandson stated it was a team effort even though he made the last shots that won the overtime game.  Remington also made the Academic All Star Team.
