COMMISSION MEETING MINUTES

February 14, 2012

 

            The Board of Davis County Commissioners met in room 236 of the Davis County

Courthouse, Farmington, Utah on February 14 at 10:00 a.m.  Members present were Chairman Bret Millburn, Commissioner Louenda H. Downs, Commissioner John Petroff, Jr., Clerk/Auditor Steve S. Rawlings, Chief Deputy Civil Attorney Bill McGuire, and Deputy Clerk/Auditor Linda May.

 

            Commissioner John Petroff  led the Pledge of Allegiance.  All were invited to stand and join in.

PILT Check to Davis County

            Justin Dolling, Northern Regional Supervisor, Utah’s Wildlife Resources, presented a check to Davis County in the amount of $489.18.  It represents the payment in lieu of taxes (PILT) for approximately 900 acres of land the Division of Wildlife Resources owns in Davis County.  The money used to pay the in lieu tax is provided by hunters and anglers in the county and across the state.  Justin asked if there were any questions.  Commissioner Downs asked about the small number of eagles this past weekend at Eagles Day at Farmington Bay in comparison to past years.  Justin stated that it is an unknown and it is speculated the eagles have perhaps gone further north.  Commissioner Downs also asked if there were any concerns about whirling disease in fish.  Justin stated not really in Davis County.

Agreement #2012-37 Holt Productions for Use of Room to Film at South Branch Library

            Chris Sanford, Davis County Library Director, presented agreement #2012-37 with Holt Productions.  The company has requested the use of a small conference room at the South Branch Library.  They will use the empty room with some props to film for Asea Inc., a health supplement company in Salt Lake.  It will be for 2 – 4 hours this afternoon.  Chris stated that the library policy says there needs to be a formal agreement between the county and the requesting company when it is for commercial purposes.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-38 Mountain Dream Homes for Construction of New Office Space, Closet, and Double Door

            Dustin Volk, Davis County Valley View Golf Course, presented agreement #2012-38 with Mountain Dream Homes.  It is for construction of a new office space within the area of the pro shop at Valley View Golf Course Clubhouse.  There is a great need for the private space to be able to conduct business and interviews.  Also a new closet and installation of a new custom fit double door from the pro shop to the café will be part of the project. Layton City Fire has approved the plan.   It is a payable of $9,865.00 and the cost was approved as part of the 2012 budget.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

            Commissioner Petroff asked Dustin to remain standing as an acknowledgement was made of recent recognitions given to Dustin.  The 2011 Utah Section PGA Award Winners were announced last week at the Sand Hollow Resort.  Congratulations are in order for Dustin who received three awards:  (1) Player of the Year; (2) Utah Section Champion; and (3) Assistant Golf Professional of the Year.  Dustin stated that Brad Stone, Davis Park Golf Course Pro, nominated him for the Assistant Golf Professional and he feels a deep sense of gratitude for Brad and all he has learned from him.  Dustin said that his aim is to “promote the game.”

Donation to The Utah Figure Skating Club

            Kent Sulser, Davis County Community and Economic Development Director, requested approval of a donation of $500.00 to The Utah Figure Skating Club.  These are funds available from the Commission Cup Golf Tournament held in 2011 and are not taxpayer funds.  The donation is allowable under the Utah Constitution and in §17-50-303 Utah Code Annotated.  Michelle Thomson, Event Coordinator, for “Rekindle the Fire Within” spoke about the upcoming event on February 16, 2012 from 6 – 8 pm at the South Davis Recreation Center in Bountiful celebrating the 10th Anniversary of Salt Lake 2002 Olympics in Davis County.    We have had only 30 days to bring the event together.  We have 42 volunteers who are helping. The Utah Figure Skating Club and Davis County Youth Hockey are 501(c)3 non-profit organizations whose mission is provide programs and encourage participation and achievement in the sport of figure skating or hockey on and off the ice.  Commissioner Downs made a motion to approve the donation commenting the proceeds are not taxpayer dollars and have come in at a different time frame.  Commissioner Petroff seconded the motion.  All voted aye.

 

            Steve Rawlings, Davis County Clerk/Auditor, was excused from the meeting due to another commitment.  Terry Tremea, Chief Deputy Administration Davis County Clerk/Auditor’s Office served in Steve’s place for the remainder of the meeting.

Agreements #2012-39 &

#2012-40 Alta Hills Farms for Rental of Legacy Center

            Mike Moake, Davis County Legacy Events Center Marketing, presented the following agreements for rental of the Legacy Center for horse shows :

            Agreement #2012-39 with Alta Hills Farms for May 2 – 6, 2012, $2,510.00/receivable

            Agreement #2012-40 with Alta Hills Farms for Oct. 3 – 7, 2012, $2,710.00/receivable

Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Documents are on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-41 with Jordan World Circus for Rental of Legacy Center

            Dave Hansen, Davis County Legacy Events Center Director, presented agreement #2012-41 with Jordan World Circus.  It is for rental of the Legacy Center for January 28, 2013.  It is a receivable of $2,000.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-42 & #2012-43 UT Health Information Network for Telecommunic-ation Network Links

            Lewis Garrett, Davis County Health Director, presented agreement #2012-42 and #2012-43 with Utah Health Information Network (UHIN).  This is the telecommunications network that links health care community participants for the exchange of electronic data.  UHIN establishes standards and guidance for use of the Network.  Agreement #2012-42 is for the Family Health Division and #2012-43 is for the Senior Services Division. Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Certificate of Substantial Completion for Wadman Construction for Children’s Justice Center

            Barry Burton, Davis County Planning Director, presented the Certificate of Substantial Completion for contract #2010-409 with Wadman Construction for the Children’s Justice Center only.  Davis County took possession on December 19, 2011 and opened for business on January 3, 2012.  The issuance starts the warranty period.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

            Barry gave an update for the ongoing construction stating the footings for the library are being poured today.  The skin is going on the outside walls of the Administration Building and membrane is going on the roof.  All three floors are rapidly moving along.  Chairman Millburn thanked Barry Burton and Tony Thompson, Davis County Planning Office, for all they are doing on top of their other duties.  Commissioner Petroff stated that we also have a great architect and builders for the project.

Acceptance of Easements #2012-44 DBH Properties LLC  for North Holmes Creek Culvert Improvement

            Acceptance of easements #2012-44 with DBH Properties LLC.  It is for the North Holmes Creek Culvert Improvement Project for Tax ID 11-522-0001, 0003, and 0005.  On this property there are 3 easements:  a permanent easement, an access easement, and a temporary construction easement.    Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor and Recorder’s Office.

            Acceptance of easements #2012-46 from Kurt Giles for the North Holmes Creek Culvert Improvement Project for Tax ID 11-641-0002.  On this property there are 2 easements:  an access easement and a temporary construction easement.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor and Recorder’s Office.

Quit Claim #2012-47  to Accept Property from Sherry Vanderwood, Robert H. Housley & Linda P. Housley & Execute Corrective Quit Claim Deed

            Execute Quit Claim #2012-47 a parcel of property (Tax ID 14-103-0021) and accept property within 2425 North from Sherry Vanderwood (part of Tax ID 14-101-0008), Robert H. Housley and Linda P. Housley (part of Tax ID 14-101-0009) and execute a corrective Quit Claim Deed (part of Tax ID 14-103-0026) to the Darwin E. Jones and Carol P. Jones Trust. 

            Ms. Sherry Vanderwood discovered this situation while having a survey of her property.  Research of the land records disclosed an Auditor’s Tax deed from 1939 that had a different legal description than what the taxes had been assessed and when recorded created an erroneous overlap on property to the south.  The parcel that matches the assessment was left abandoned.  Ms Vanderwood had had the property surveyed and description created, and has been reviewed by the Davis County Surveyors Office to resolve the issues of record title and possession.  Ms. Vanderwood has secured the services of Mr. Jon Call, attorney, who has been involved with this request along with Mr. Bill McGuire of the Davis County Attorney’s Office.  This request was discussed in the September 28, 2011 Properties Management Committee Meeting with a recommendation to proceed with the exchange.  The exchange is approximately 1.70 acres.  Commissioner Petroff made a motion to approve the actions as described.  Commissioner Downs seconded the motion.  All voted aye.  Documents are on file in the office of the Davis County Clerk/Auditor and the Recorder’s Office.

Declare Parcel of Land Surplus & Authorize Notice of Sale

            Tony Thompson also asked for ratification to declare a parcel of land (part of Tax ID 08-076-0097) as surplus and authorize notice of sale.  This property is located at approximately 800 West State Street in Farmington and adjacent to and abutting on the north side of Tax ID 08-076-0083.  This property is part of the Davis Justice Complex and Farmington District Courthouse.  A request from the State of Utah Division of Facilities Construction and Management the abutting property owner has been received.  The notice of sale had to be emailed to the newspapers yesterday to meet their deadlines for publication.  The area being declared surplus is 60,015 sq. ft or 1.378 acres.  Commissioner Downs made a motion to ratify.  Commissioner Petroff seconded the motion.  All voted aye.

 

            Kevin Fielding, Davis County Sheriff’s Office presented the following:

Articles of Agreement #2012-48 UT Div. of Homeland Security

            Articles of Agreement #2012-48 with the Utah Division of Homeland Security.  The documents are part of the necessary paperwork required to be signed for the Homeland Security Grants.  Commissioner Downs made a motion to authorize the Chairman to sign.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-49 UT Dept of Public Safety/911 Committee for ECaTS

            Agreement #2012-49 with the Utah Department of Public Safety/911 Committee.  It is for the ECaTS data access for the Sheriff’s Department.  Commissioner Petroff made a motion to approve.  Commissioner Downs seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Agreement #2012-50 Chris Convery to New Directions Classes at Jail

            Agreement #2012-50 with Chris Convery to teach up to ten “New Directions” classes for Davis County jail inmates for one year.  It is a payable of $10,750.00.  These classes help the inmates with skill sets for leaving the jail and entering back into the community.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.  Document on file in the office of the Davis County Clerk/Auditor.

Davis County Emergency Operations Plan #2012-51

Major Incident Response Plan #2012-52

            Davis County Emergency Operations Plan #2012-51 and Davis County Major Incident Response Plan #2012-52 were presented.  The plans are consistent from year to year but the contact information is being updated.  Commissioner Downs made a motion to accept the plans.  Commissioner Petroff seconded the motion.  All voted aye.  Documents are on file in the office of the Davis County Clerk/Auditor.

 

            Commissioner Petroff made a motion to convene as the Board of Equalization.  Commissioner Downs seconded the motion.  All voted aye.

Property Tax Register Approved

            Ross Bartholomew, Davis County Tax Administration Director, presented the property tax register.  The register reflects 22 items for approval.  Commissioner Downs made a motion to approve.  Commissioner Petroff seconded the motion.  All voted aye.

 

            Commissioner Downs made a motion to reconvene the regular commission meeting.  Commissioner Petroff seconded the motion.  All voted aye.

 

Commission Minutes Approved

            Commissioner Downs made a motion to approve the commission meeting minutes of January 31, 2012.  Commissioner Petroff seconded the motion.  All voted aye.

Check Registers Approved

            Check registers as prepared by the Davis County Clerk/Auditor’s Office were approved with a motion from Commissioner Petroff.  Commissioner Downs seconded the motion.  All voted aye.  Documents are on file in the office of the Davis County Clerk/Auditor.

 

Commission Comments:

            Commissioner Millburn stated there is a lot going on in the county and the country.  The scope and complexity in Washington DC affects us here.  A welcome was extended to Adam Gardiner from Congressman Rob Bishop’s office and Zenock Bishop from Senator Orrin Hatch’s office.

 

                        Terry Tremea, Chief Deputy Administration Davis County Clerk/Auditor’s Office stated that elections are upcoming.  Maps are being printed by the State.  Within a month caucuses will be held on the following dates:  March 13 for Democrats and March 15 for Republicans.
